Now the question is when a person applies for a Government Appointment, of he is fully fit and eligible in sports for which he is applied, whether the written test is also essential. The central Administrative Tribunal said, in appointment in government services under sports quota is achievement in sports and a written test is redundant of a candidate is meritorious. The Tribunal declared this by rejecting the appeal of a candidate who was not selected for the post of lab technician at JIPMER - Jawaharlal Nehru Institute of Post Graduate Medical Education and Research at Puduchery.

S. Oumapady applied for the post of lab technician in sports quota and got higher marks in the written test. But the officially selected another applicant S.Sendhilvel. It seems JIPMER would have selected Sendhilvel based on written test.

But, M.T. Arunan, the counsel of JIPMER said that the merit list was prepared on the performance of sports. Organising written test is an in adverting error and this mistake did not confer any right for appointment.

The applications and the relevant documents of the candidates have been sent to department of personnel and training, Puduchery. Sendhivel, in fact topped in sports performance. K.Elango, the member of judicial bench and P.Prabakaran, the administrative member said the guidelines of department of personnel and training has to be followed in this regard. In this case both Oumapady, as well as, Sendhilvel did not win any medals, but they have participated in nation –level sports. Senthilvel had participated in few sports in National level, Oumapady did not submit any proof in this regard. The bench rejected the application.
