Rejection of Tanjore Medical college application

The Board of Governor of Medical Council of Inida denied permission for Tanjore Medical College without quoting any reason.

Madras High Court states that this is a clear violation of the constitution. The court adds that this action, clearly offends Article 14.

The Tanjore Meidcal College and Hospital Vandalur, challenged the order of MCI (July 12, 2013) declining renewal of permission for the IV batch of 150 MBBS students for 2013 – 14. The council quoted certain deficiencies in its report. The council issued a show cause notice and the college submitted a compliance report on  May. After another inspection, the permission was denied.

The college filed a writ petition of 29th July.  A single Judge held that the material available clearly showed that the college had satisfied the requirements of MCI. The MCI presented appeal against this order.  It was indicated that there were unrectified deficiencies in the college.

The Bench said a perusal of the boards resulting showed that no specific reason had assisted to show how the college was not entitles to renewal of permission. The impugned order of July 12 also did not contain the reason for the rejection of permission.  There was no error in the order issued by the single judge the court said.
