Transfer cert for La Marts boy

Justice Aniruddha Bose of Calcutta High Court on Monday permitted La Martiniere School for Boys to hand over a transfer certificate and requisite documents to Srijan Banerjee, so that he could take admission in another school.

 

Earlier, Srijan’s father, Partha Pratim Banerjee, had filed a writ petition challenging the decision of the school to refuse his son promotion to a higher class, under the Right to Education Act. The petition’s plea for an interim order was rejected by Calcutta high court on Monday.

“Since the act had taken effect from April 1, 2010, and the school had asked the petitioner to take the transfer certificate on March 29, the student in this case cannot come under the purview of the act,” said Justice Aniruddha Bose. The next hearing of the case has been fixed on September 3.

Supriya Dhar, secretary of the Board of Governors (BoG) of La Martiniere School for Boys, said: “We have not yet received the order. However, we have learned that the judge has rejected the plea for an interim order. He has directed us to grant the transfer certificate and other necessary documents. We have already prepared the necessary papers and will hand them over when parents of Srijan Banerjee approach the school.”

When contacted, Partha Pratim Banerjee said: “I would like to take advice and then proceed accordingly. I have faith in the country’s judiciary. I had thought that the court would take a decision only after considering a few other facts.”

Sanjay Smart, a teacher of the school, had earlier been arrested on a complaint lodged by Partha Pratim. Smart had been charged with extortion, criminal intimidation and cheating after he allegedly demanded a laptop from him in return for favours. (TNN)
